Prison Law

Henry’s Solicitors Prison Law Department offers a wealth of experience to assist prisoners nationwide, at any stage of their sentence, in all areas of prison law including:

  • Disciplinary matters including governor and independent adjudications
  • Re-categorisation reviews
  • Parole Board paper reviews and hearings
  • Adverse developments in open conditions
  • Recall reviews and hearings
  • Annual recall review and hearings
  • Category A reviews
  • Sentence planning and progression matters
  • Appeals and reviews for sentences and convictions
  • HDC applications
  • Challenging SOPO
  • Judicial Review

The Legal Aid Agency now only funds cases which are before the Parole Board, when the Parole Board has the power to direct release or when prisoners face disciplinary proceedings before an independent adjudicator.

Despite the Legal Aid Agency reducing the scope of prison law we are able to assist prisoners with any prison law matters on a private basis.

We know people serving a prison sentence may not have family support and therefore may feel unable, due to financial constraints, to instruct a firm to assist with their prison law matters. We understand this and therefore we undertake work at very competitive rates on a fixed fee basis which will be agreed at the start to make sure we undertake what needs to be done at the agreed price.

Representation and Distance

A lot of firms are unable to represent prisoners due to location and sometimes if a prisoner is transferred to another area for example HMP Featherstone to HMP Northumberland they are informed they can no longer act for them.

Due to our location in the North West of England we can attend upon prisoners in any prison across the country including the North East, Eastern England, Midlands, Southern England, London and the South West.

We regularly attend prisons across the Country to represent clients at Parole Hearings or take instructions on legal visits but this does not mean we cannot be contacted. All telephone calls that come through our switchboard can be transferred to our mobiles at no extra cost to our clients meaning that we are contactable throughout the day.

Our work

We have assisted many prisoners with Release Applications before the Parole Board and in December 2013 successfully judicially reviewed HMP Frankland’s decision to place our client on Child Safeguarding Measures with insufficient evidence to justify it.

Our Service

We offer a friendly service.  We like to get to know our clients as individuals and not as cases.

If you would like to discuss instructing us or require any further information regarding the services we provide please do not hesitate to contact Samantha Jones or Emma Gauden at the Stockport Office.
